CheckMyRide Site and Community Terms
By accessing any the pages or functions set forth at CheckMyRide.com and any linked affiliate websites (“CMR Sites”), you hereby agree to comply with, and that Experian Information Solutions, Inc. (“Experian”) shall have the right to enforce against you, the following terms and conditions (“Agreement”) with respect to your access to and participation in the community at the CMR Sites (“Community”), and your use of the various communication and personalization tools and services ("Community Services") offered at the CMR Sites.
General Behavior.
Our forum is designed to be a friendly and welcoming place, and one in which members can post without their motives, intelligence, or other personal characteristics being questioned by others. Members who post in a manner that makes other members unwelcome or uncomfortable, or who conduct themselves in a manner in any way detrimental to the Community, will lose posting privileges.
Participation.
Experian requires that you provide certain registration information to participate in the Community. YOU UNDERSTAND AND AGREE THAT ANY PERSONAL INFORMATION THAT YOU PROVIDE WILL BE DISPLAYED AT YOUR PROFILE PAGE AND WILL BE AVAILABLE TO ALL VISITORS TO THE COMMUNITY. Experian may delete your account and prohibit your access to and participation in the Community and use of the Community Services at any time, for any reason, and without any obligation of notice to you.
Postings.
You agree that you shall not make posts promoting web sites, products, or services, affiliate links or promotional signatures or include embedded or hidden content, or including any copyrighted material or links to any third party sites. You also warrant and represent to Experian that you have the right to post all information and content that you post at the Community, including having obtained all necessary copyright licenses or other third party rights. Experian shall own and have the unrestricted right to use all information, materials, photographs, and posts that you make, upload, or post at the Community. You acknowledge that Experian reserves the right to monitor without notice any and all information transmitted or received through CMR Sites and that your posts may be examined, recorded, copied, removed and/or used by Experian without notice or obligation to you.
Privacy Policy.
Experian shall operate the Community and use your personal information, and you shall access and use the CMR Sites and Community, in accordance with the Privacy Policy set forth here.
Availability of Community Services. Experian does not guarantee that the Community Services will be uninterrupted or error-free or that you will be able to access or use all the Community Services or all of their features at all times. Experian may change, suspend or discontinue any (or all) Community Services, or any of their features, at any time. We may also impose limits on the use of or access to certain features or portions of the Community Services, or restrict your access to any part or all of the Community Services, in all cases without notice to you or liability to us.
Password Security.
You are responsible for maintaining the confidentiality of your password. You are responsible for all usage and activity in the Community Services through your username and password, including use of your username and password by any third party. Your account is unique to you and may not be transferred to any third party. You should notify Experian of any known or suspected unauthorized use of your username and password.
Indemnification.
You agree that you will be responsible for any damages resulting from any violation of this Agreement. You agree to indemnify and hold Experian and its employees, officers, directors and agents harmless from and against any claim or demand, including reasonable attorneys' fees, made by a third party arising from any posting you make at the CMR Sites.
Limitation of Liability.
YOU AGREE THAT YOU RETAIN AND ASSUME ALL RISK AND LIABILITY WITH RESPECT TO YOUR ACCESS TO THE CMR SITES AND THE COMMUNITY AND THAT EXPERIAN SHALL HAVE NO LIABILITY TO YOU WITH RESPECT THERETO OR OTHERWISE IN CONNECTION WITH THIS AGREEMENT, WHETHER FOR DIRECT OR INDIRECT, CONSEQUENTIAL, SPECIAL PUNITIVE OR ANY OTHER DAMAGES OR ANY KIND.
General.
Experian reserves the right, in our sole discretion and at any time, to make changes to this Agreement and our other policies concerning the use of the Community Services. We also reserve the right, in our sole discretion and at any time, to waive or modify any of the terms of this Agreement as they apply to a specific posting or item of content or as they apply to a specific participant, without affecting the application of these terms to any other postings, content or participants. Changes will be effective when made and the updated Agreement (or applicable policy) is posted on the CMR Sites; provided, however, that no such change shall be applicable to any dispute between you and us that arises prior to the time such change is effective. Accordingly, you should visit this page periodically to review its provisions. If any of provision of this Agreement shall be deemed invalid, void or for any other reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the balance of this Agreement.
